1. Introduction

Welcome to Shippy Ghana ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our shipping and logistics services, mobile applications, website, and related services (collectively, the "Service") operated by Shippy Ghana, a company incorporated in Ghana.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Acceptance of Terms

By creating an account, using our mobile application, website, or any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms constitute a legally binding agreement between you and Shippy Ghana. If you are using our services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Service Description

Shippy Ghana provides comprehensive shipping and logistics services including but not limited to:

  • Local and international package delivery
  • Real-time shipment tracking
  • Warehouse and fulfillment services
  • Customs clearance assistance
  • Insurance and protection services
  • Mobile application for shipment management

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

4. User Accounts

To use certain features of our Service, you must create an account. You are responsible for:

  • Providing accurate and complete information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

5. Payment Terms

Payment for our services is due in advance unless otherwise agreed upon. We accept various payment methods including:

  • Credit and debit cards
  • Mobile money payments
  • Bank transfers
  • Digital wallets

All prices are quoted in Ghana Cedis (GHS) unless otherwise specified. Prices may be subject to change with 30 days' notice. Refunds are processed according to our Refund Policy.

You are responsible for any taxes, duties, or fees imposed by government authorities related to your shipments.

6. Shipping & Delivery Policies

6.1 Package Requirements

  • Packages must be properly packaged and labeled
  • Prohibited items include hazardous materials, illegal substances, and restricted goods
  • Weight and dimension limits apply as specified in our service guidelines

6.2 Delivery Times

Delivery times are estimates and not guaranteed. Factors affecting delivery include weather conditions, customs clearance, and recipient availability.

6.3 Failed Deliveries

If delivery cannot be completed, we will attempt redelivery according to our standard procedures. Additional fees may apply for multiple delivery attempts.

7. Liability & Insurance

Our liability for loss or damage to shipments is limited to the declared value or the actual value of the goods, whichever is lower, up to a maximum of GHS 5,000 per shipment unless additional insurance is purchased.

We are not liable for:

  • Consequential or indirect damages
  • Loss of profits or business opportunities
  • Damage to perishable goods
  • Losses due to delays beyond our control

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Shippy Ghana and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service without our written permission.

9. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service.

We comply with applicable data protection laws including Ghana's Data Protection Act. By using our Service, you consent to the collection and use of information in accordance with our Privacy Policy.

10. Dispute Resolution

Any disputes arising from these Terms or your use of our Service will be resolved through:

  1. Good faith negotiations
  2. Mediation if negotiations fail
  3. Binding arbitration under Ghanaian law

These Terms are governed by the laws of Ghana. Any legal action must be brought in the courts of Ghana.

11. Termination

We may terminate or suspend your account and access to our Service immediately, without prior notice, for any reason, including breach of these Terms.

You may terminate your account at any time by contacting our customer service team. Upon termination, your right to use the Service will cease immediately.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our Service.

Your continued use of the Service after any modifications constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
